OPPO® X SPRINGBOKS PROMOTION TERMS AND CONDITIONS:
1.1 In this document, unless the context clearly indicates a contrary intention, the following terms shall have the meaning as defined in this clause apply:
(a) “Business Day” means a day other than a Saturday or a Sunday or a day which from time to time is a proclaimed public holiday in the Republic of South Africa;
(b) “Campaign” means the promotional campaign to which these rules pertain as run by the Promoter during the Campaign Period
(c) “Campaign Period” means the period between 00:00 on 10 July 2023 and 00:00 (midnight) on 31 August 2023. No late entries will be accepted under whatsoever circumstances;
(d) “CPA” means the Consumer Protection Act, 68 of 2008;
(e) “Participant” means an individual who enters the Campaign and meets the criteria set out in any natural person who qualifies in terms of clause 4.1;
(f) “POPI” means the Protection of Personal Information Act, No 4 of 2013;
(g) “Promoter” means, Boang Technology South Africa t/a OPPO;
(h) “Prizes” means as further described in clause 6;
(i) “Rules” means the rules contained in this document, as required by Section 36 (3) (c) of the CPA; and
(j) “Winner” means a Participant who is successful in the Promotional Campaign and is notified as such by the Promoter in terms of clause 6.1.
2.1 This Campaign is organized by the Promoter.
2.2 The Promoter is offering Prizes for the qualifying Winner under the terms and conditions as set out in this Rule.
2.3 A copy of these rules can be found on www.OPPOrewards.co.za throughout the Campaign Period.
3.1 This Rule is a public document and may also be made available upon request.
3.2 By entering into the Campaign, the Participants agrees and acknowledges that they have read and understand the Rules as the Rules contain certain terms and conditions which may:
(a) limit the risk or liability of the Promoters, or any relevant third party; and/or
(b) create risk or liability for the Participant; and/or
(c) compel the Participant to indemnify the Promoter or a relevant third party; and/or
(d) serve as an acknowledgement by the Participant of certain facts.
3.3 Any personal data submitted by you will be used solely in accordance with current POPI, the CPA and the Promoters’ respective privacy policies. The Promoters may contact you for marketing purposes, on the basis that you will have the option to opt out at each interaction.
4.1 The Participant, by entering into the Campaign, expressly acknowledges that:
(a) they have been given an appropriate opportunity to first read the Rules before entering the Campaign and that they understands and thereby agrees to the Rules;
(b) it is the Participant’s own responsibility to ensure that in the event that they is selected as Winner, they will comply with all COVID 19 restriction as may be imposed by South Africa and/or country of destination in order to enjoy the benefit of the Prizes and Participants irrevocably and unconditionally indemnifies the Promoters for any expenses, damages and/or costs of whatsoever nature suffered or may be suffered by the Participant as result of non-compliance of this clause (b).
4.2 All Participants (and their companion, in the event that the Participants is selected as Winner) must 18 years or older, in possession of a valid passport. For the avoidance of doubt, “valid” in these Rules means a passport which (a) has not expired and/or (b) will not expire and/or (c) eligible to travel in and out of South Africa to and from the country of destination at (i) the time when the Participant is announced as Winner AND (ii) at the time when the Winner enjoys the Prize.
4.3 The following person may not participate in the Campaign and will be automatically be deemed to be disqualified upon entry:
(a) Any director, member, partner, employee, agent or consultant of the Promoter, the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members; and
(b) Any director, member, partner, employee, agent or consultant of Telkom; Cell C; Vodacom and MTN, and the marketing service providers or any person who directly or indirectly controls or is controlled by these entities, including their spouses, life partners, business partners or immediate family members
5. HOW TO PARTICIPATE
5.1 To participate in the Campaign, all qualifying Participants must:
(a) Purchase a Reno10 Pro+ or Reno10 device from any retailer nationwide or online; and
(b) Visit opporewards.co.za to enter; and
(c) Fill in your IMEI number and contact details
5.2 All qualifying Participants must keep their invoice or till slip as proof of purchase and (if requested by Promoter) submit it to the Promoter.
5.3 All Participants must enter in their correct contact details. If a Participant drawn as a Winner has given incorrect contact details, the Promoter reserves the right to select another winner in terms of the Rules.
5.4 Participants may only enter once per device purchased.
5.5 The Promoter shall not be responsible for any lost, damaged, delayed, incorrect or incomplete entries for any reason whatsoever. Proof of sending will not be accepted as proof of receipt.
6.1 Participants stand to win an a trip to France to watch a Springboks game (to be selected at the Promoter’s sole discretion), including cruiser liner accommodation (to be selected at Promoter’s sole discretion).
6.2 Winners may choose to take 1 (one) additional person of the age, 18 years and older.
6.3 It is the Winners’ sole responsibilities to ensure that they and their companions are available to travel to the country of destination (France) between the travel dates given by the promoter (25 September – 2 October 2023).
6.4 All Winners will be required to provide their names, digital copy of valid passport and contact details and to sign an acknowledgment of receipt of the Prize within 24 hours of being successfully contacted by the Promoter. Should the Promoter not receive the required documentation timeously, you will forfeit the prize and you will have no right to claim against the Promoter for any reason whatsoever.
6.5 (if applicable), the Prize may include delivery and Winners will be required to provide the Promoter with a valid day time delivery address to enable delivery.
6.6 Any extras not included in the Prize as detailed above will be at the expense of the Winner.
7.1 Winners will be selected by means of a random draw by 1 September 2023 and will be notified telephonically where the Winners will be required to verify their details. The Promoter (or its agent) will endeavor to contact the Winners twice within 24 hours after their names are drawn. If a Winner cannot be contacted during this period, the Winner will be deemed to automatically forfeit the Prize and another Winner will be selected in accordance with the Rules.
7.2 Winners must produce an electronic copy of their and their companion’s passports on the same day they are contacted by the Promoter to qualify for the Prize.
7.3 The Promoter reserves the right to name the Winners publicly. By entering this Campaign, Winners irrevocably and unconditionally agree to the publication of their names by the Promoter.
8.1 In addition to what’s contained in the Rule, Participants’ attention is draw to the following:
(a) It is a material term of the Campaign that Participation in the Campaign constitutes acceptance of this Rule and Participants irrevocably and unconditionally agree to abide by these Rules.
(b) all Participants to this Campaign participate (including while enjoying the benefit of the Prizes) entirely at their own risk.
(c) The destination of travel is subject to the outcome of the ongoing tournament and date of travel will be communicated to the Winner after the draw. Winner will be required to confirm their availability or forfeit the Prize. Confirmation of availability is required within one month of announcement of the Winner selection.
(d) The Promoter reserves the right, at its sole and absolute discretion, to disqualify any Winner if the Promoter (i) found or suspects any unlawful, dishonest and /or (including without limitation, through the manipulation of code or otherwise frequently falsifying data.) by the Participants, or (ii) Participants and his campion is illegible to travel. In which event an alternative Winner will be selected by the Promoter in accordance with this Rule..
(e) Any images submitted in connection with the Campaign will be displayed on various Promoters’ social media pages.
(f) By entering the Campaign, Participant agree that images may be broadcast via digital feeds or printed for physical events and further that these images can be used for marketing and promotional material and activities by Promoters during and beyond the Campaign at its discretion and as is required.
(g) Participant grant to Promoters, its affiliates and sub-licensees, a non-exclusive worldwide, royalty-free license to use, copy, display publicly, distribute, modify and alter any materials, including without limitation video/text/photo material posted in connection with the Campaign (to the extent not assigned to Promoters as set out herein), with the right to sublicense and assign the foregoing rights. Each Participant hereby represents that they own all rights to materials, including without limitation video/text/photo material, submitted in connection with the Campaign.
(h) It is the Participants’ sole responsibility to provide correct and up-to-date personal details as required by the Promoter for the purposes of this Campaign and allow the Promoter to process such information in terms of POPI;
(i) the Promoter reserves the right to unilaterally amend or terminate the Campaign and/or amend this Rule at any time, with or without reasons and/or prior notice, at their sole and absolute discretion. In such event, all Participants agree to waive any rights that they may have pertaining to the Campaign and acknowledge that they have no recourse against the Promoter, their employees, agents, partners, suppliers, or sponsors;
(j) the Promoter’s selection of Winner is final and in the event of a dispute, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by Participants to follow the rules) in their sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants from the Campaign;
(k) The Promoter shall not be responsible for the failure of any technical element relating to this Campaign that may result in an entry not being successfully submitted.
(l) No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
The Prize is not exchangeable for cash and is not transferable.
9.1 By entering the Campaign, the Participant expressly agrees to the following indemnifications:
(a) the Participant indemnifies and holds harmless the Promoter and its promotional partners, their employees and their agents (“the Indemnified Parties”) of any and all liability (including indirect and/or consequential) pertaining to any damage, cost, injuries and losses of whatsoever nature and howsoever arising as a result of their participation in the Campaign and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy; and
(b) the Participant accepts that the Indemnified Parties will not be responsible for any costs, damage or otherwise, howsoever incurred by the Winner subsequent to claiming the Prize.
10.1 Any personal data relating to the Winner or any other Participant will be used solely in accordance with CPA and POPI and will not be disclosed to a third party without the Participant’s prior consent.
10.2 This Campaign is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network.
10.3 The Participant by part taking in the Campaign consents to their personal information to be shared with the Promoter’s employees, contractors or agents for the purpose of this Campaign and for the purpose of sharing future promotions.
